Welcome to Zedmarket (“Zedmarket”, “we”, “us”, or “our”). These Terms of Service ("Terms") govern your access to and use of the Zedmarket mobile application, website, and related services (collectively, the "Platform") provided by LSKVIBES LTD ("Zedmarket", "we", "us", or "our"). By creating an account, accessing, or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Platform.
1. The Zedmarket Platform
Zedmarket is a digital marketplace platform that allows users to list, discover, sell, and buy goods and services.
We are a platform provider and are not a party to any transaction between buyers and sellers.
We do not own, inspect, or guarantee any items listed on the Platform.
Sellers are solely responsible for their listings and fulfilment.
All transactions occur directly between Users.
2. Definitions
User: Any person who registers, browses, buys, sells, or otherwise uses Zedmarket.
Seller: A User who lists products or services.
Buyer: A User who views, contacts, or transacts with Sellers.
Product: Any item or service listed on Zedmarket.
Premium Services: Paid features including subscriptions, product sponsorships, exclusive ads, and contact reveal.
Transaction: Any payment made via the Platform, including through third-party providers such as PawaPay.
3. Eligibility
You must, at least:
Be 18 years old (or the age of majority in your jurisdiction)
Have the legal capacity to enter into a binding agreement
Provide accurate and complete information
Zedmarket reserves the right to suspend or terminate accounts that do not meet eligibility requirements.
4. Account Registration & Security
4.1 Account Creation
To access certain features, you must register an account and create login credentials. You must provide accurate, current, and complete information during the registration process. You are responsible for keeping your account information up-to-date.
4.2 Account Security
You are solely responsible for safeguarding your password and for all activities that occur under your account. You must notify Zedmarket immediately of any unauthorised use of your account.
Zedmarket is not liable for losses caused by unauthorised access resulting from your negligence.
5. User Conduct and Content
You are responsible for your conduct and any data, text, information, usernames, graphics, images, photos, profiles, audio, video clips, links, and other content or materials (collectively, "Content") that you submit, post, and display on the Platform.
5.1 Listings
As a seller, you agree that you have the legal right to sell any items you list. You must describe your items accurately and disclose all relevant details. You are responsible for the content of your listings, including any edits.
Sellers must ensure that:
Listings are accurate and lawful
Prices, descriptions, and images are truthful
Products comply with applicable laws
5.2 Prohibited Conduct
You agree not to:
Use the Service for any illegal or unauthorised purpose.
Violate any laws in your jurisdiction.
Harass, abuse, threaten, or intimidate other Zedmarket users.
Post false, inaccurate, misleading, defamatory, or libellous content.
Distribute spam or unsolicited electronic communications.
Interfere with the Platform or another user's enjoyment of the Platform.
Zedmarket reserves the right to remove listings without notice if violations occur.
5.3 Content Restrictions
You may not list or post any Content that:
Is illegal, counterfeit, stolen, or fraudulent.
Infringes upon any third-party's intellectual property rights.
Is obscene, hateful, or pornographic.
Contains personal contact information in areas not explicitly designated for such information.
Promotes any of the above.
5.4 License to Your Content
You grant Zedmarket a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of your Content to provide and promote the Service.
5.5 Product Editing & Deletion
Sellers may edit or delete their listings at any time
Zedmarket reserves the right to remove or disable listings for policy violations, legal compliance, or platform integrity. Deletion does not remove responsibility for prior transactions or disputes.
6. Ratings & Reviews
Users may leave public ratings and reviews for products they have interacted with.
Reviews must be truthful, based on first-hand experience, and comply with our Content Restrictions.
Zedmarket reserves the right to remove reviews that violate these Terms without notice.
7. Transactions and Payments
Buyers and sellers are solely responsible for their transactions, including refunds. Zedmarket provides the platform but is not involved in the actual sale or refund.
Payment processing services may be provided by Pawapay or other third-party providers. Zedmarket is not responsible for their performance.
8. Fees, Subscriptions, and In-App Purchases
All fees are non-refundable, except as required by law.
8.1 Premium Subscriptions
Zedmarket offers optional premium subscriptions that provide enhanced features.
Billing is managed by the platform on which you installed the app (e.g., Apple App Store, Google Play Store).
Subscriptions will automatically renew unless cancelled through your app store account settings before the end of the current billing period.
8.2 Product Sponsorships
Purchase of "Sponsorships" increases visibility of product listings for a fixed duration but does not guarantee results.
ii. This is a one-time, non-renewing purchase processed through your app store account.
We do not guarantee increased sales, visibility outcomes, or buyer engagement.
8.3 Contact Reveal Fee
Accessing a seller's direct contact information may require a one-time fee.
ii. This fee grants you temporary access to the seller's contact details as described at the time of purchase.
This is a non-renewing purchase processed through your app store account.
8.4 Seller Service Fees
To support the Zedmarket platform and cover operational, statutory, and processing costs, we charge sellers a service fee for each successful sale made through the Service.
This fee is calculated as a percentage of the total transaction amount. The current fee structure is made available within the app or on our official website.
The service fee is automatically deducted from the payout amount due to the seller for the transaction.
We reserve the right to change the service fee at any time and will provide you with reasonable notice of any fee changes before they become effective.
Sellers are responsible for collecting and remitting all applicable taxes for their sales. Our service fee is exclusive of any taxes that you may be required to pay.
8.5 Exclusive Ads
Zedmarket may display exclusive first-party ads as part of the platform experience.
9. Account Suspension & Deletion
You may terminate your account at any time through the account settings within the app.
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms.
Upon termination, your right to use the Service will immediately cease. We may, but are not obligated to, remove your listings, reviews, and other Content.
Deletion does not remove responsibility for prior transactions or disputes.
10. Intellectual Property
All rights, title, and interest in and to the Service (excluding User Content) are and will remain the exclusive property of Zedmarket and its licensors. The Platform is protected by copyright, trademark, and other laws. You may not use the Zedmarket name, logo, or trademarks without our prior written permission.
11. Privacy & Data Protection
The use of Zedmarket is governed by our Privacy Policy, which explains data collection, storage, processing, and user rights. By using the Platform, you consent to such processing.
12. Disclaimers and Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Zedmarket makes no warranties of any kind, express or implied, regarding the operation of the Service or the information, content, or materials included therein.
We do not guarantee the quality, safety, legality, or authenticity of items listed, the truth or accuracy of Content, or the ability of sellers to sell items or buyers to pay for them.
To the fullest extent permitted by law, Zedmarket shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.
13. Indemnification
You agree to indemnify and hold harmless Zedmarket and its officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.
14. General Terms
Changes to Terms: We reserve the right to modify these Terms at any time. We will provide notice of such changes by posting the revised Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
Entire Agreement: These Terms constitute the entire agreement between you and Zedmarket and supersede all prior agreements.
Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be struck, and the remaining provisions will be enforced.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of Zambia, without regard to conflict of law principles.
Any disputes shall be resolved in the courts of competent jurisdiction in Zambia, unless otherwise required by law.
